Naast pornografische tekst en beelden, een copyright notice brouwerijhaacht.be doet sterk kwader trouw vermoeden

CEPINA 19 oktober 2017, case no. 44435 (brouwerijhaacht.be) Brouwerijhaacht.be is op 27 maart 2017 geregistreerd door Gelske Jongerden. Brouwerij Haacht is de op drie na grootste (en bekende) bierbrouwerij in België en actief sinds 1975 en houdster van woordmerk HAACHT. "This  website contains  texts and  images  of  an  explicit pornographic nature. Besides the  pornographic  texts  and  images,  the  sole  text  on  the website is merely a copyright notice “© brouwerijhaacht.be” at the bottom." Licensee did not submit a response. Non-response is indeed indicative of a lack of interests inconsistent with an attitude of ownership and a belief in the lawfulness of one’s own rights. It is appropriate for the Third-Party Decider to infer  a prima  facie-case  of  bad-faith registration. Having a pornographic website related to the Domain Name can tarnish the distinctiveness and reputation of the Complainant's rights and business generally.
