EUIPO beoordeelt gebruik e.plus voor telecommunicatiediensten ten onrechte als onvoldoende

Gerecht EU 30 september 2026, IEF 23905; IEFbe 4343; ECLI:EU:T:2026:614 (e plus). ePlus Inc. had verzocht om vervallenverklaring van het Uniemerk e.plus van Telefónica Germany wegens het ontbreken van normaal gebruik in de zin van artikel 58 lid 1 onder a UMVo. De nietigheidsafdeling verklaarde het merk vervallen voor alle betrokken waren en diensten en de kamer van beroep liet die beslissing in stand. In beroep beperkte Telefónica haar vordering tot de telecommunicatiediensten in klasse 38. Het Gerecht stelt voorop dat bij de beoordeling van normaal gebruik alle relevante feiten en omstandigheden in aanmerking moeten worden genomen en dat verschillende bewijsstukken gezamenlijk kunnen aantonen dat van normaal gebruik sprake is. De relevante periode liep van 10 november 2017 tot en met 9 november 2022. De kamer van beroep had haar beoordeling in de bestreden beslissing echter beperkt tot de aard van het gebruik en geoordeeld dat niet was aangetoond dat e.plus in die periode werd gebruikt voor de betrokken telecommunicatiediensten. Volgens het Gerecht is dat oordeel onjuist. Telefónica had onder meer reclame-uitingen voor onder de merken ALDI TALK en Ortel Mobile aangeboden telecommunicatiediensten, facturen voor prepaidkaarten en opwaardeertegoeden waarop e.plus of e.plus+ voorkwam en verklaringen van medewerkers over dat gebruik overgelegd. Dat prepaidkaarten en opwaardeertegoeden als betaalmiddel kunnen worden aangemerkt, is niet beslissend: het merk werd in die context gebruikt om de herkomst aan te duiden van de telecommunicatiediensten waartoe die producten toegang gaven. De stukken, in onderlinge samenhang beoordeeld, tonen volgens het Gerecht daarom voldoende de aard van het gebruik van e.plus voor de daadwerkelijke verrichting van telecommunicatiediensten in klasse 38 aan. Ook de overgang van E-Plus naar O2 bewijst niet dat het gebruik van e.plus in de relevante periode was gestaakt. De kamer van beroep heeft daarom een beoordelingsfout gemaakt door te oordelen dat de aard van het gebruik voor telecommunicatiediensten niet was bewezen. Het Gerecht vernietigt haar beslissing voor zover deze betrekking heeft op telecommunicatiediensten in klasse 38. Daarmee staat nog niet vast dat aan alle vereisten voor normaal gebruik is voldaan, omdat de kamer van beroep de overige aspecten van het gebruik, zoals plaats, tijd en omvang, niet inhoudelijk had beoordeeld.

43      It should be observed in that regard that the Board of Appeal explained in paragraphs 64 and 65 of the contested decision that, with regard to the evidence relating to telecommunications services in Class 38, the findings in the decision of the First Board of Appeal of EUIPO of 30 June 2023 (Joined Cases R 1199/2022-1 and R 1711/2022-1), confirmed by the judgment of 16 October 2024, e.plus (T‑604/23, not published, EU:T:2024:695), could not be applied in the present case since those findings were based on data relating to 2016, as was apparent from a report by the Bundesnetzagentur für Elektrizität, Gas, Telekommunikation, Post und Eisenbahnen (German Federal Agency for Electricity, Gas, Telecommunications, Post and Railway; ‘the Bundesnetzagentur report’). The Board of Appeal inferred from that that ‘the existence of a mobile telephone network in Germany under [the contested EU trade mark]’ could not be confirmed for 2017, the first year of the relevant period.

44      It is clear from paragraph 44 of the judgment of 16 October 2024, e.plus (T‑604/23, not published, EU:T:2024:695), in particular, as the applicant rightly claims, that the reference to the Bundesnetzagentur report was made only to support the conclusion that the marketing of SIM cards and prepaid cards during the relevant period in the case which gave rise to that judgment, namely between 12 April 2016 and 11 April 2021, demonstrated that the figurative mark e.plus was used to designate mobile telephone services, operating mobile telephone networks and message sending.

45      Furthermore, several items of evidence on which the Board of Appeal had thus relied in the decision of the First Board of Appeal of EUIPO of 30 June 2023 (Joined Cases R 1199/2022-1 and R 1711/2022-1) in finding that the figurative mark e.plus was used for those telecommunications services in Class 38 are substantially identical to the evidence included in the file in the present case. It is clear from paragraphs 86 and 87 of that decision that, in examining the nature of use of the mark at issue in that case, the First Board of Appeal had considered that the overall assessment of the evidence submitted demonstrated that that mark was used for services in that class. That is the case, in particular, for the affidavit made by a senior management employee of the applicant concerning the marketing of the prepaid starter package ‘aldi talk prepaid starter-set’ referred to in the first indent of paragraph 40 above; for the advertising poster dating from 2019 concerning the service offering marketed under the mark Ortel Mobile referred to in the second indent of paragraph 37 above; and for the statement made by a senior management employee of Ortel Mobil referred to in the third indent of paragraph 40 above.

46      Thus, contrary to the finding made by the Board of Appeal in the contested decision, the Bundesnetzagentur report cannot be considered to be crucial in demonstrating that the contested mark was no longer used from 2017.

47      The Board of Appeal could not therefore reject the relevance of the evidence relied on by the applicant, which was the same as that which led to the finding that there was genuine use of the mark e.plus in the decision referred to in paragraph 45 above, in so far as at least some of that evidence related to the relevant period in the present case, but, at the very least, in accordance with the principles of equal treatment and good administration, should have considered with especial care whether it should decide in the same way or not, provided that respect for those principles is consistent with respect for legality (judgment of 28 June 2018, EUIPO v Puma, C‑564/16 P, EU:C:2018:509, paragraph 22).
